It's three strikes and he's out for a Metropolitan Transportation Authority cop who was already a two-time loser on YouTube with videos depicting police misconduct.
Michael Matrisciano, 33, has filed a lawsuit in Brooklyn Federal Court to stay on the job despite his outrageous conduct in the past that landed him on probation and one last chance.
Matrisciano was slapped with a 42-day suspension by MTA police chief Michael Coan for the two unrelated YouTube videos.
On New Year's Eve 2010, Matrisciano was recorded decking a man in Penn Station, and while disciplinary charges in that incident were pending he uploaded a video of another uniformed MTA cop 'rubbing his crotch area,' according to court papers.
A source familiar with the case said Matrisciano was not the maker of the lewd video that was recorded in a nonpublic lunch room used by cops. The other cop was also disciplined, the source said.
Matrisciano struck a deal that saved his job but he was warned that if he committed another 'serious violation' he would be terminated, the suit states.
Fast forward one year and Matrisciano was back in hot water, accused of committing auto insurance fraud by falsely claiming he had taken a defensive-driving class.
Matrisciano asserts he was found guilty by the MTA without being given the chance to rebut the allegations.

'[The MTA defendants] were eager to force the plaintiff's termination while ignoring far more egregious acts by other officers including arrests for insurance fraud [and] domestic violence,' the suit contends.
Matrisciano, a 10-year-veteran, has been suspended from the force without pay, a source said, despite claiming in the suit that he has already been fired.
An MTA spokesman said the agency would not comment on pending litigation. Matrisciano's lawyer did not return a call.
